Article 1 – Scope and Acceptance of the General Terms and Conditions of Sale


These General Terms and Conditions of Sale (GTC) govern the contractual
relationship between:


-  ESSENTY-PARIS, SASU, whose registered office is located at 102, avenue
de la Champs-Élysées, 75008 Paris, registered with the Paris Trade and
Companies Register under number 94308814600015, intra-community VAT

-  Hereinafter referred to as "the Seller", and any natural or legal person making
a purchase via the website www.essenty-paris.fr, hereinafter referred to as
"The Customer".

The purchase of a product or service through this website implies unconditional acceptance of these Terms and Conditions. ESSENTY-PARIS products are intended exclusively for sale to end consumers, whether individuals or legal entities, excluding any resellers or intermediaries acting on behalf of resellers. Therefore, the customer declares that they are acting as an end consumer and that they do not intend to resell ESSENTY-PARIS Products.


Article 2 – Products and Services Offered


The website www.essenty-paris.fr offers silk scarves for sale. Each product is accompanied by a detailed description provided by the Seller. Product photographs are not contractually binding. The Seller cannot be held responsible for any errors in the presentation.


Article 3 – Prices


The prices displayed on the website are in euros (€), inclusive of all taxes (TTC), and must be paid at the time of placing your order. The Seller reserves the right to modify its prices at any time but undertakes to apply the rates in effect at the time of the order. ESSENTY-PARIS reserves the right, at its sole discretion and under terms and conditions that it alone determines, to offer promotional offers or price reductions. If a price is displayed that is clearly incorrect, for whatever reason (computer bug, human error, technical error, etc.), the order will be cancelled, even after validation, and the Customer will be informed.


Article 4 – Orders


The Customer selects the desired products on the website, adds them to the shopping cart, and then confirms the order after having read and accepted these Terms and Conditions.
Any order implies acceptance of the prices and descriptions of the products available for sale. The Seller will acknowledge receipt of the order by sending a confirmation email. The sale will only be considered final after this email has been sent and the price has been fully paid. The Seller reserves the right to cancel any order from a Customer with whom there is a dispute regarding the payment of a previous order.


Product Availability


Product offers are valid while stocks last. Indeed, at the time the order is confirmed, there may be a difference between the available inventory and the existing physical inventory (for example, in the case of simultaneous orders for the same product by several customers). The sale is therefore subject to the availability of the Products in stock. Furthermore, ESSENTY-PARIS reserves ownership of the Products until payment has been made.
The availability date of a pre-ordered Product will be expressly indicated on the product page. If the availability date changes, you will be immediately notified by email and/or through your customer account. If a Product becomes unavailable after you have placed your order, we will notify you by email as soon as possible, offering you the option to order another Product presented on the Website as a replacement or to cancel your order. ESSENTY-PARIS assumes no liability in the event of out-of-stock or unavailability of Products. ESSENTY-PARIS reserves the right to change the Products offered on the Website at any time and without prior notice.


Article 5 – Payment


Payment is made online when ordering, by credit card (Visa, Mastercard, etc.), or any other method offered on the website. Payments are secured by SSL encryption. The order is considered confirmed after payment validation. In the event of a refusal by the bank payment center, the order will be automatically canceled.


Article 6 – Delivery


6.1 Delivery Times


Delivery times are indicated at the time of ordering. They are expressed in business days and are provided for informational purposes only.

6.2 Delays


The Seller shall not be held liable for any delay in delivery attributable to the carrier or due to force majeure.


6.3 Areas Served


Deliveries are made within mainland France and the geographic areas specified on the website.


6.4 Reservations upon Receipt


Products are delivered to the address indicated by the Customer when ordering and must be handed over in person against signature. This signature, affixed to the delivery slip or any other equivalent document, constitutes acknowledgement of proper receipt of the Products and transfer of liability. Without a signature, delivery cannot be made. Any anomaly noted upon receipt must be notified in accordance with the terms and conditions set out in the article relating to complaints and reservations. The Customer must check the condition of the packaging and products upon delivery. Any anomaly must be reported to the carrier and the Seller within 48 hours. The Customer assumes all risks (including loss, theft, or damage) associated with the delivered Products from the time they are delivered to the address indicated when ordering or from the time they are collected in the store.


Article 7 – Right of Withdrawal


7.1 Legal Deadline


In accordance with Article L.221-18 of the French Consumer Code, the Customer has 14 days to exercise their right of withdrawal, from the date of receipt of the products, without having to provide a reason or pay a penalty.


7.2 Terms and Conditions


The Customer shall inform the Seller of their decision to withdraw by email: info@essenty-paris.fr.

7.3 Return of Products

Products must be returned in their original condition, complete, unused, in their original packaging, at the Customer's expense, to the address provided by the Seller. Refunds will be issued within 14 days of receipt of the returned item.


7.4 Exceptions


The right of withdrawal does not apply to:
   -  customized or custom-made products,
   -  digital content downloaded immediately after purchase.


Article 8 – Legal Guarantees

In accordance with Articles L.217-4 to L.217-14 of the French Consumer Code, the Customer benefits from the legal guarantee of conformity. The Customer also benefits from the warranty against hidden defects provided for in Articles 1641 to 1649 of the French Civil Code. In the event of a non-compliant or defective product, the Customer must contact customer service at info@essenty-paris.fr with proof of purchase and photos of the product.


Article 9 – Liability


The Seller shall not be held liable for non-performance of the contract in the event of force majeure, disruptions, or strikes in postal services, transportation, or communications. The Customer is solely responsible for the selection of products and their suitability for their needs.


Article 10 – Personal Data


The personal data collected is necessary for processing orders and managing customer relations. In accordance with the French Data Protection Act of January 6, 1978 and the General Data Protection Regulation (GDPR), the Customer has the right to access, rectify, delete, and object to the processing of their data. To exercise these rights, they may contact the Data Protection Officer at the following address: https://www.cnil.fr/fr/webform/nous-contacter. The Seller undertakes never to disclose this data to third parties without the Customer's consent.


Article 11 – Intellectual Property


All elements of the site (texts, images, videos, logos, etc.) are the exclusive property of the Seller or its partners. Any reproduction or use without prior authorization is strictly prohibited.


Article 12 – Applicable Law and Disputes


These General Terms and Conditions are governed by French law. In the event of a dispute, the Customer may resort to conventional mediation or any other alternative dispute resolution method. Failing this, the dispute will be submitted to the competent courts of Paris.
